1. Agreement Acceptance

By accessing portfoliotoptlly.christmas, submitting an application, or purchasing any physical transformation program, you agree to be bound legally by these Terms of Service. If you do not accept these terms in full, you must refrain from utilizing our services.

2. Scope of High-Performance Coaching

Portfoliotoptlly provides specialized elite physical fitness design, biomechanical exercise instruction, and metabolic nutritional planning. Our services do not constitute formal medical diagnosis, clinical treatment, or psychological therapy.

3. Medical Clearance & Health Disclaimer

Resistance training and physical recomposition protocols carry inherent physical demands. You warrant that you have obtained medical clearance from a licensed physician prior to initiating any training track. You assume full responsibility for any physical exertion undertaken under our program guidelines.

4. Client Commitments & Code of Conduct

Our program success relies upon precise execution. Clients are expected to:

• Accurately log weekly body composition metrics and complete check-in forms.
• Maintain respectful, professional communication with master coaching staff.
• Refrain from reproducing, sharing, or re-selling custom workout manuals or proprietary software algorithms.

5. Payment Terms, Subscription & Cancellations

Coaching fees are billed strictly in advance. Given the intensive allocation of coach time and custom algorithm generation, setup fees and initial coaching retainers are non-refundable once the 1-on-1 diagnostic call has taken place.

6. Intellectual Property Protection

All training methodologies, instructional video media, brand aesthetics, software assets, and documentation published under Portfoliotoptlly remain the exclusive intellectual property of Portfoliotoptlly Apex Elite Ltd. Unauthorized duplication will result in immediate legal recourse.

7. Limitation of Liability

To the maximum extent permitted by applicable UK law, Portfoliotoptlly Apex Elite Ltd shall not be held liable for indirect, incidental, or consequential damages resulting from platform downtime or improper exercise execution contrary to program guidelines.

8. Governing Law & Jurisdiction

These Terms of Service are governed exclusively by the laws of England and Wales. Any legal proceedings arising from these terms shall be submitted to the jurisdiction of the courts of London, United Kingdom.
